DA Confirms Harvey Weinstein Will Stay in New York Until Retrial Concludes
There are plans for Harvey Weinstein to continue serving his time in New York as his retrial for sexual offenses approaches.
On Monday, Queens District Attorney Melinda Katz announced that the 72-year-old former film executive will remain in New York until his ongoing legal proceedings are finalized. This retrial comes after his previous rape conviction was overturned earlier this year.
Weinstein will only be transferred back to California—the site of another rape conviction—once his New York case is resolved. “The California sentence will be his priority to serve first,” Katz stated.
Weinstein’s publicist, Juda Engelmayer, expressed relief that he won’t be extradited to California, allowing him to prepare for his upcoming retrial in New York. Engelmayer mentioned, “It’s crucial for him to be close to his legal team to handle the New York case effectively, which we believe he will win.”
A New York appeals court overturned Weinstein’s 2020 rape conviction in April, citing that the judge wrongly allowed in “irrelevant” testimony from women not involved in this case. His retrial is expected to start in November.
The appeals decision did not affect his 2022 rape conviction in California, where he received a 16-year sentence. Previously, he was sentenced to 23 years in New York.
Recently, a spokesman for Weinstein confirmed that he was taken to the Bellevue Hospital Prison Ward in New York due to various ongoing health issues, including diabetes, high blood pressure, and spinal stenosis. He had also tested positive for COVID-19 and suffered from double pneumonia.
