Sean “Diddy” Combs is set to testify in his own defense in the imminent trial concerning sex trafficking and racketeering.

His attorney, Marc Agnifilo, spoke to TMZ for its rapid-release documentary “The Downfall of Diddy: The Indictment” to elaborate on the accusations faced by the Bad Boy Records mogul.

Agnifilo mentioned that Combs, currently incarcerated until the trial, intends to take the stand. “I think he is very eager to share his side,” Agnifilo stated, adding, “I don’t know that I could keep him off the stand.”

Discussing the 2016 hotel surveillance footage showing Combs assaulting his ex-girlfriend Cassie Ventura, Agnifilo emphasized that Combs is prepared to recount every detail, including what is visible in the footage.

“He possesses a narrative that only he can express in his own way in real-time,” the lawyer remarked regarding Combs’ relationship with Cassie. “It’s a profound narrative involving love, sorrow, and heartbreak.”

Diddy’s Lawyer Indicates No Likely Plea Deal

When asked about the possibility of a plea deal for Diddy, Agnifilo responded, “That isn’t up to me. It lies with Mr. Combs, and I don’t foresee it occurring as he maintains his innocence.”

Agnifilo elaborated that Combs feels a responsibility not just to himself but to his family and others who might feel targeted by the authorities. “He believes he can set a precedent, demonstrating that a Black man can successfully fight federal charges,” the attorney stated.

“I genuinely think he might be the one to achieve that,” he added.

Diddy’s Lawyer Questions Baby Oil Evidence

Agnifilo questioned the relevance of baby oil to the case, stating, “I don’t see what baby oil has to do with this.” When the host suggested it could be used as a lubricant, he quipped, “Perhaps; but I don’t understand why you’d need a thousand. One bottle lasts a long time.”

He continued, “(Combs) has a large home; he purchases items in bulk. I assume there are Costcos near his residences.”

A Costco representative reportedly confirmed to TMZ that their U.S. stores do not carry baby oil.

Lawyer Defines ‘Freak Offs’ as Just ‘Threesomes’

Agnifilo characterized Combs’ “freak-offs” as merely “threesomes.”

He remarked, “This involved his girlfriend at the time and an alleged third party,” referring to Cassie.

“I’ve spoken with several men involved in these situations and asked, ‘Did anyone appear to be non-consenting?’ They all responded, ‘Absolutely not. We wouldn’t have proceeded had there seemed to be any lack of consent from anyone in the room,'” he noted.

Agnifilo affirmed that during these encounters, “no one was overly inebriated or impaired.”

In a letter dated September 17 to the judge arguing for Combs to remain jailed until trial, U.S. Attorney Damian Williams claimed that over 50 alleged witnesses and victims had been interviewed and that several videos illustrating Combs’ “freak-offs” had been collected. Furthermore, prosecutors allegedly secured at least “90 cellphones, laptops, and cloud storage accounts, along with over 30 additional electronic and storage devices.”

Williams asserted, “The vast and varied sources of evidence will serve as compelling proof of guilt during any future trial.”

Recently, CNN shared footage from 2016 showing Combs, who was only dressed in a towel, rushing towards Cassie by an elevator. He appeared to hit her, pull her by the hair, throw her to the ground, and kick her twice while she lay on the ground, before grabbing her belongings.

Agnifilo informed Levin, “Mr. Combs personally went out and apologized for the video. It does not serve as proof of sex trafficking. Throughout their decade-long relationship, which was marked by love, there was a significant amount of toxicity and drug involvement.”

He added: “The issues they faced were not because of their intimate moments. Instead, they were due to mutual infidelity. What we witness in that video is awful. It’s inexcusable, and we do not attempt to excuse it. However, it isn’t related to the charges being brought against him.”

Prosecutors cite hotel footage of Diddy and Cassie in their accusations against him

The indictment against Combs, submitted confidentially by the U.S. Attorney’s Office for the Southern District of New York on September 12 and made public on September 17, references the hotel security video in an overview of the racketeering charges made against him.

The indictment claims, “From at least 2009 onwards, Combs has repeatedly assaulted women by hitting, punching, dragging, throwing objects, and kicking them on various occasions.”

“Some of these assaults were witnessed by others, including one incident at a hotel in Los Angeles around March 2016, which was captured on video. In that instance, he kicked, dragged, and hurled a vase at a woman trying to leave.”

During the arraignment on September 17, Combs pleaded not guilty to charges of sex trafficking, racketeering, and transportation for prostitution purposes. Although his defense team sought to have him released on a $50 million bond, two judges have decided he should remain in custody.

Combs’ attorneys have pledged to contest the court’s decisions in the U.S. Court of Appeals for the Second Circuit. His next court session is set for October 9.
