DOJ issues warning to Elon Musk regarding pro-Trump giveaways, reports indicate

WASHINGTON − Reports on Wednesday revealed that the Department of Justice (DOJ) has cautioned billionaire entrepreneur Elon Musk, along with his pro-Trump political action committee, concerning their practice of giving away $1 million daily to registered voters in critical swing states, which could breach federal election regulations.

According to CNN, the DOJ’s public integrity division, responsible for examining potential electoral misconduct, recently sent a letter to Musk’s America PAC.

The department declined to provide comments when contacted by YSL News. In turn, Musk did not reply to a request for comments through his social media platform X, previously known as Twitter.

In recent weeks, Musk has openly supported and financially backed Republican presidential candidate Donald Trump, even launching the $1 million daily lottery just last weekend.

In a post on X, Musk claimed these giveaways are random, stating that recipients “do not have to register as Republicans or vote in the election on November 5.”

However, the online petition from his PAC stipulates that participants must agree to support the Second Amendment, which reflects Trump’s stance against gun control measures, a point of contention with his Democratic counterpart, Vice President Kamala Harris.

The petition articulates, “Our objective is to gather 1 million registered voters from swing states to pledge their support for the Constitution, especially regarding free speech and the right to bear arms.” It also includes links to voter registration forms for eligible states like Pennsylvania, Georgia, Nevada, Arizona, Michigan, Wisconsin, and North Carolina.

Currently, Musk has not publicly responded to the legal concerns surrounding the lottery’s restriction to registered voters.

Robert Heberle, who oversees the election crimes unit within the DOJ, remarked in a “brief warning letter” to America PAC attorney Chris Gober that offering value to influence voting clashes with U.S. laws prohibiting payment for vote persuasion, as reported by the media source 24sight.news.

ABC News has also stated, citing a source, that the letter originated from the DOJ’s election crimes division within its public integrity section.

Musk’s online petition revealed that four individuals have claimed the prize so far – the first three from Pennsylvania followed by one from North Carolina. The PAC notes that the offer will end on Election Day, November 5.

On Monday, eleven former Republican members of Congress, alongside justice officials and advisers, requested Attorney General Merrick Garland to probe Musk for providing monetary incentives to swing state voters who sign the petition from his political organization.

The letter argued that Musk’s awarding of prizes violates laws that forbid compensating individuals to register to vote.

In their statement, the former Republican officials, no longer in government, noted, “We are not aware of anything comparable in recent political history.”
