Georgia Court Overrules Arguments on Trump’s Bid to Disqualify Fulton County District Attorney

 

 

Georgia appeals court cancels Trump’s bid to disqualify Fulton County DA


On Monday, the Georgia Court of Appeals announced the cancellation of the oral arguments scheduled for President-elect Donald Trump’s attempt to remove Fulton County District Attorney Fani Willis from the 2020 election interference case involving Trump and 14 others.

 

In a short statement, the court mentioned that the hearing set for December 5 has been canceled “until further notice from this court.”

Willis, an experienced prosecutor, filed charges against Trump and several associates in August 2023, alleging they tried to overturn the results of the 2020 presidential election in Georgia, which Trump lost to President Joe Biden. Four of the defendants have accepted plea deals.

 

Trial Delayed

The extensive racketeering case has been paused since June, awaiting a resolution to Trump’s efforts to have the district attorney excluded from the case. Trump claims that Willis’s relationship with Nathan Wade, the lead prosecutor she appointed for the case, affected her ability to handle the proceedings fairly.

 

Trump and other defendants are asking the Court of Appeals to overturn a prior decision by Fulton County Superior Court Judge Scott McAfee. In March, McAfee ruled that Willis could continue her role in the case as long as Wade resigned, which he did immediately. The judge indicated that some trial preparations could still proceed during the pending appeal.

Trump has mentioned that if he were to win the presidency again, he would seek to dismiss various legal challenges against him, while Special Counsel Jack Smith is wrapping up two federal cases against Trump.

 

If Trump were in office again, he would have limited power to halt the Georgia case in comparison to the federal charges, though legal experts believe that it would be unlikely for a state case to proceed against a sitting president due to constitutional and practical challenges. Willis was reelected to her second term in November.
