The Transportation Security Administration (TSA) announced plans to start enforcing the REAL ID requirement on May 7, 2025. To ease potential disruptions, the agency is contemplating a gradual implementation strategy.

 

A recent Notice of Proposed Rulemaking from the TSA indicates that just 56% of driver’s licenses and other state-issued identification cards are compliant with the REAL ID law, which was enacted by Congress in 2005.

The notice further states, “Due to past extensions of the REAL ID enforcement timeline, the Department of Homeland Security (DHS) believes that the public might not feel pressed to secure a REAL ID. This belief could lead to a delay in many states’ efforts to promote REAL ID adoption, possibly resulting in a last-minute rush for REAL IDs as the deadline approaches.”

The proposed strategy involves a gradual enforcement of REAL ID rules that would last two years, starting May 7.

 

While federal agencies will still need to begin enforcing REAL ID-based identification on May 7, 2025, this proposed rule would give them flexibility over the subsequent two years to determine how to gradually implement card-based enforcement based on security needs, operational considerations, and effects on public service provided by their agency.

 

The TSA reminds travelers that they will still have to show REAL ID-compliant documents at airports after May 7, or face possible delays during security screenings.

 

If this phased enforcement plan is approved, the specific details will be determined by each agency in collaboration with the DHS.
