Donald Trump requests to overturn New York hush money verdict and delays sentencing


Former President Donald Trump filed a motion in a New York appeals court on Tuesday, seeking to overturn his conviction related to a hush money scandal and to delay his sentencing, which is set for Friday.

 

This motion follows Judge Juan Merchan’s denial of Trump’s request to postpone the sentencing pending the appeal. The judge also rejected Trump’s effort to have the case dismissed. Trump claimed he was protected from prosecution as a past president.

Judge Merchan stated that moving forward with sentencing would bring closure to the situation, suggesting that Trump should receive no prison time, fines, or probation during the appeals process. He mentioned that Trump’s plea for a delay mostly repeated arguments that had already been made in earlier proceedings.

 

Trump believes that a July ruling by the Supreme Court, which granted former presidents immunity from criminal charges for their official acts, protects him from this case. However, Judge Merchan clarified that the case pertains to Trump’s personal actions.

 

In May, Trump was found guilty on 34 counts of falsifying business records. He had paid his former lawyer, Michael Cohen, who then paid adult film actress Stormy Daniels to keep quiet about an alleged sexual encounter before the 2016 election.

 

This legal dispute unfolds just weeks before Trump’s planned inauguration to the presidency on January 20. The appeal will be heard in the appellate division of New York’s first judicial department.

 

Trump’s lawyer, Todd Blanche, who is also slated to become his deputy attorney general, argued that this immunity should encompass the transition period before Trump resumes office.
