New York Court Upholds Donald Trump’s Hush Money Sentencing Decisions

 

 

New York’s Highest Court Denies Delay in Donald Trump’s Hush Money Sentencing


New York’s top court has declined to stop President-elect Donald Trump’s sentencing, which is set for this Friday, relating to his hush money case.

 

This ruling on Thursday adds to Trump’s challenges as he seeks to postpone sentencing following a Tuesday decision by an appeals court that maintained the sentencing date. Trump has also approached the U.S. Supreme Court to intervene, but they have yet to respond to his plea.

A jury in Manhattan reached a unanimous verdict on May 30, finding Trump guilty of falsifying business records 34 times to cover up a hush money payment to adult film actress Stormy Daniels in the lead-up to the 2016 presidential election.

 

Judge Juan Merchan has already indicated that he may sentence Trump to an “unconditional discharge,” which would mean that the incoming president wouldn’t be subjected to any ongoing supervision or requirements. Although sentencing could typically range from community service to prison time for the charges Trump faced, Merchan described the unconditional discharge as “the most viable solution” to resolve the case, allowing Trump to appeal without hindering his forthcoming presidency.

 

“While this Court as a matter of law must not make any determination on sentencing prior to giving the parties and Defendant an opportunity to be heard, it seems proper at this juncture to make known the Court’s inclination to not impose any sentence of incarceration, a sentence authorized by the conviction but one the People concede they no longer view as a practicable recommendation,” Merchan noted in a January 3 order.

Prosecutors from Manhattan District Attorney Alvin Bragg’s office suggested in a December 9 court filing that Merchan may not be able to impose jail time due to the special legal protections Trump will have during his presidency.

 

The court “is not required to impose a sentence of incarceration at all, and could even impose an unconditional discharge,” the prosecutors stated.

 

Judge Merchan ruled that Trump could participate virtually instead of attending in person, should he choose, to ease the mental and physical demands during his transition to the presidency.
