Sean “Diddy” Combs’ legal representatives are urging a judge to hold an immediate evidentiary hearing after notes were taken from his jail cell.

The attorneys criticized what they described as “unacceptable government actions,” arguing that prosecutors now have access to Diddy’s “confidential notes to his attorneys regarding defense witnesses and strategies,” according to a filing obtained by YSL News.

In a filing last Friday, prosecutors contended that Combs’ new request for bail should be rejected because he is allegedly trying to interfere with the case by conducting “social media campaigns that he claims aim to influence the jury.”

This filing included redacted notes discovered by Bureau of Prisons officials during a sweep of the facility, which prosecutors claim indicate that Combs paid a witness to support him on Instagram.

On Monday, Combs’ attorneys disclosed that they were unaware until Friday that these notes had been confiscated from his jail cell and subsequently handed over to the U.S. Attorney’s Office and trial prosecutors. They assert that prosecutors have “used this evidence to justify keeping Mr. Combs in custody.”

The legal team labeled the “targeted seizure” as a breach of “due process” and requested Judge Arun Subramanian to set an evidentiary hearing to allow the government to explain the nature of the search and the items recovered.

Combs is currently being held at the Metropolitan Detention Center in Brooklyn, New York, following his arrest in September on accusations of racketeering, sex trafficking, and facilitating prostitution. He has entered a plea of not guilty.

Earlier this month, Combs’ legal team submitted another request—marking their fourth overall—for the hip-hop entrepreneur to be released from jail with what they referred to as “a highly substantial, comprehensive bail proposal.” Previous attempts to secure his release on bail have been denied by several judges.

In a filing on November 8, Combs’ lawyers proposed additional conditions to their earlier bail arguments to demonstrate that he does not pose a flight risk. They also countered the claim that he is a threat to society, stating that the government’s case against him does not have the level of “weight” they imply.

The legal team contended that his detention “renders trial preparation impossible” due to inconsistent access to legal representation and the evidence against him.

Like previous bail requests, this latest motion includes a $50 million bond secured by Combs and his mother’s homes in Florida, the provision of 24/7 monitoring by approved security, restrictions on internet and phone access outside of legal consultations, a pre-approved visitor list consisting of select family members, and surrender of the rapper’s and his family’s passports.

Additionally, the request outlined Combs’ willingness to undergo “full home detention” at his $48 million Miami residence “or an alternative suitable location in New York.” Visits from family would be supervised by his security team, and Combs would be subjected to “substance testing” as necessary.

A status conference regarding Combs’ case has been set for Tuesday afternoon.
