Cruise Line Faces Lawsuit After Hidden Camera Discovered in Bathroom Cabin

 

Royal Caribbean guest files lawsuit after hidden camera discovery in cabin restroom


 

A passenger on a Royal Caribbean International cruise is taking legal action against the cruise line and a former employee, alleging that the staff member secretly installed a camera in her cabin’s bathroom.

 

The lawsuit, which is a class action, was submitted on Tuesday in the Southern District of Florida on behalf of the guest, referred to as Jane Doe, along with “all others in similar situations.” It claims that Arvin Joseph Mirasol, a past stateroom attendant, recorded images of the plaintiff while she was changing and partaking in private activities during a cruise on the Symphony of the Seas in February.

Mirasol was sentenced to 30 years in federal prison in August for his actions, which involved recording guests, including children, with hidden cameras while they were in vulnerable states. He still faces additional charges of video voyeurism in Florida.

The complaint states that “upon information and belief,” Mirasol shared or posted the images of the Plaintiff online, including on the dark web, without her knowledge or consent. The impact of this incident has caused the passenger significant emotional distress, leading to physical symptoms such as insomnia, pain, and dizziness.

 

The lawsuit accuses Royal Caribbean of being negligent, asserting that the company “knew or should have known” about the potential for such sexual assaults to occur due to previous incidents. It references a similar case in which a passenger on the Harmony of the Seas was arrested last year for recording individuals, including children, in a public restroom.

Reports of sexual assault on cruise ships rose to 131 in 2023, an increase from 87 in the prior year and 101 in 2019, right before the cruise industry was halted due to the pandemic.

The complaint claims that the cruise line failed to implement adequate security measures, training, or oversight to prevent incidents of this nature and did not inform guests about such crimes.

 

The lawsuit also states that Royal Caribbean did not contact passengers who stayed in cabins attended by Mirasol between December 1, 2023, and February 26, 2024. Up to 960 passengers may have been affected, according to the filing.

 

Jason Margulies, an attorney representing the plaintiff, stated, “If you’re a company genuinely concerned about the well-being of your passengers, the appropriate action would be to inform these individuals that they could potentially be victims of such an invasion.”

In response, Royal Caribbean stated to YSL News, “The safety and privacy of our guests are our top priorities, and we have a zero-tolerance policy for such conduct. We promptly reported the matter to law enforcement and terminated the staff member involved. Due to the ongoing litigation, we cannot provide further comments at this time.”

 

The lawsuit is seeking unspecified damages, including punitive damages, and requests a jury trial.
