Garth Brooks’ motion to dismiss former makeup artist’s sexual assault lawsuit rejected


The renowned country artist faced accusations of raping his former hair and makeup artist in 2019.

Garth Brooks’ attempt to have the sexual assault lawsuit against him dismissed was unsuccessful, as the related case proceeds in court.

 

The country music star sought to dismiss the sexual assault allegations made against him by his former hair and makeup artist, who is suing under the pseudonym Jane Roe.

On December 11, U.S. District Court Judge Michael W. Fitzgerald denied Brooks’ request to dismiss the case for now, while another defamation and extortion lawsuit he filed in Mississippi against the same woman is ongoing.

The Tennessean, affiliated with the YSL News network, reached out to Brooks’ legal team for a response.

 

The dismissal motion was denied “without prejudice,” allowing Brooks the option to reapply for dismissal later on.

 

The December 11 ruling by the judge also put a hold on the California lawsuit until the Mississippi case is resolved, as both lawsuits revolve around similar issues.

 

In the Mississippi lawsuit, which was sealed shortly after being filed, Brooks identified himself as John Doe to preemptively sue the woman before her allegations came to light in court.

 

Brooks later confirmed his identity as the plaintiff in the Mississippi suit, where he disputes the sexual assault claims and accuses the woman of attempting to extort him by threatening to file the lawsuit.

 

The woman claimed in her lawsuit that Brooks raped and sexually assaulted her in 2019 during a trip to Los Angeles for a Grammy Awards tribute performance. She also alleged multiple instances of sexual misconduct throughout her employment.

Brooks’ request to dismiss the lawsuit follows an earlier attempt by his legal team. In November, his lawyers sought to merge the two lawsuits and asked Judge Fitzgerald to dismiss the woman’s claims and require her to refile in Mississippi federal court, where Brooks is suing her.

 

Later that month, the lawsuit against Brooks was transferred from California state court to federal court.
