Trump’s Appeal Denied: Hush Money Sentencing in New York Goes Forward

 

 

Donald Trump’s federal appeal to halt sentencing in New York hush money case has been denied


A federal appeals court dismissed former President Donald Trump’s request on Thursday to stop a court ruling that allows his sentencing related to hush money to proceed in New York on November 26.

 

The contested ruling was made by federal Judge Alvin Hellerstein, who decided against transferring the case away from New York Judge Juan Merchan or delaying Trump’s sentencing.

In its brief order on Thursday, the US Court of Appeals for the Second Circuit supported Hellerstein’s decision. The court turned down Trump’s “emergency” request, citing the postponement he had already received. Originally, Trump was set to be sentenced on September 18, but Judge Merchan had allowed him to delay that date past the election when he requested a postponement on September 6.

 

Representatives for Trump and Manhattan District Attorney Alvin Bragg’s office did not respond promptly to requests for comments.

 

Judge Hellerstein had previously denied Trump’s request to temporarily reverse his earlier decision.

 

This series of court activities is part of Trump’s efforts to stop Merchan from imposing sentencing after he was found guilty on 34 counts of falsifying business records. The jury concluded that he was attempting to cover up a hush money payment made to adult film actress Stormy Daniels as part of a conspiracy to unlawfully influence the 2016 election.

In his refusal to take the case from Merchan, Hellerstein stated that Trump’s claims of bias against Merchan should be addressed in state appellate courts and that Trump cannot move into federal court after the trial, as he was not prosecuted for any official presidential actions that were contrary to the Supreme Court’s ruling on presidential immunity on July 1.

 

Before the sentencing was postponed, Trump had urged the appeals court to intervene, arguing that otherwise his scheduled September sentencing would disrupt the election process. After the delay, his lawyers requested again that the appeals court take action, insisting that federal courts should handle presidential immunity matters. Judge Merchan has stated he will make a ruling on this on November 12.

 

The prosecutors from Alvin Bragg’s office opposed Trump’s request, stating that shifting the case to federal court “would be extraordinarily disruptive and disrespectful” to the state court overseen by Merchan.
